Terms and Conditions
1. Introduction
This Agreement sets forth the terms and conditions under which Max Boost Consulting ("Company," "we," or "us") provides digital marketing services to its clients ("Client" or "you"). By engaging our services, you agree to comply with and be bound by these terms and conditions.
2. Scope of Services
Max Boost Consulting offers a comprehensive range of digital marketing services, including but not limited to search engine optimization (SEO), social media marketing, pay-per-click (PPC) advertising, content creation, web design, and consulting.
3. Service Delivery Models
3.1. Consultation Fees
Consultation services are billed either on a one-time basis or on a retainer basis, as agreed upon with the Client.
3.2. Digital Products and Services
Digital products and services provided by Max Boost Consulting or its partners are billed on a monthly subscription basis.
4. Client Onboarding
4.1. Agreement and Initial Payment
To initiate services, the Client must sign a digital agreement (proposal) and pay all set-up fees and upfront costs, including the first month's subscription fee.
4.2. Commencement of Services
Work will commence upon receipt of the signed agreement and full payment.
5. Payment Terms
5.1. Upfront Payment
All payments are required upfront. Due to the nature of our services and associated costs, we do not offer refunds.
5.2. Non-Refundable Services
Expenses such as advertisements and designer fees are non-recoverable and therefore non-refundable.
6. Dispute Resolution
6.1. Initial Contact
In the event of a dispute, the Client should contact us at hello@maxboostconsulting.com. We will strive to resolve disputes promptly and fairly.
6.2. Mediation and Arbitration
Should initial attempts at resolution fail, disputes shall be referred to mediation or arbitration in accordance with the laws of Cyprus.
7. Refund Policy
No refunds shall be issued unless explicitly stated in promotional offer terms and conditions.
8. Confidentiality and Non-Disclosure
8.1. Confidential Information
Max Boost Consulting is committed to maintaining the confidentiality of all client information. Confidential information shall not be disclosed to third parties without the Client’s prior written consent, except as required by law.
8.2. Data Protection
We adhere to all applicable data protection regulations, including the General Data Protection Regulation (GDPR).
9. Termination Clause
9.1. Termination by Client
The Client may terminate their subscription for upcoming months by providing written notice before the payment period ends.
9.2. Termination by Company
Max Boost Consulting reserves the right to terminate this Agreement with immediate effect in the event of non-payment or breach of terms by the Client.
10. Intellectual Property
10.1. Ownership
All materials and deliverables created by Max Boost Consulting during the course of providing services remain the intellectual property of Max Boost Consulting.
10.2. License
The Client is granted a non-exclusive license to use the materials and deliverables for their intended purpose.
11. Performance Guarantees
Max Boost Consulting does not provide performance guarantees due to the variable nature of digital marketing and external influencing factors.
12. Client Responsibilities
12.1. Accurate Information
The Client is responsible for providing accurate and timely information necessary for the provision of services.
12.2. Liability for Misrepresentation
Max Boost Consulting shall not be liable for errors or issues arising from incorrect or incomplete information provided by the Client.
13. Indemnification
The Client agrees to indemnify, defend, and hold harmless Max Boost Consulting from any claims, damages, or expenses arising from their use of our services.
14. Limitation of Liability
Max Boost Consulting shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services. Our total liability shall not exceed the amount paid by the Client for the services in question.
15. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Republic of Cyprus and applicable European Union laws.
16. Amendments
Max Boost Consulting reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the amended terms.
